<p>The Nashville Office market ended the second quarter<br />
2011 with a vacancy rate of 9.9%.</p>
<p>The vacancy rate was down over the<br />
previous quarter, with net absorption totaling positive 129,194 square feet in<br />
the second quarter. Vacant sublease space increased in the quarter, ending the<br />
quarter at 479,885 square feet.</p>
<p>Tenants moving into large blocks of<br />
space in 2011 include: Jackson National Life Insurance moving into 154,737<br />
square feet at One Greenway Centre; and Willis Re, Inc. moving into 101,303<br />
square feet at One Century Place.</p>
<p>Rental rates ended the second quarter<br />
at $18.59, a decrease over the previous quarter.</p>
<p>A total of four<br />
buildings delivered to the market in the quarter totaling 44,685 square feet,<br />
with 356,211 square feet still under construction at the end of the quarter.</p>

<p>KNOXVILLE, Tenn. &#8212; Slightly more than half of business executives participating in a survey of global supply chain trends expect firms that have outsourced manufacturing to begin moving back toward the United States in the next two years.</p>
<p>The survey by <a href="http://www.worldtrademag.com/">World Trade 100</a> and the <a href="http://www.utk.edu/">University of Tennessee</a> found 52% of 240 executives from various companies think “near-shoring” will increase for industry in general.</p>

<p>But the study also showed 11% of the executives thought outsourcing or off-shoring would decline for their companies over the next two years.</p>
<p>&nbsp;</p>
<p>“This no doubt reflects the debate going on in firms regarding the future of outsourcing,” wrote J. Paul Dittmann, executive director of the <a href="http://scm.utk.edu/">UT Global Supply Chain Institute</a>, in the July edition of <em>World Trade</em> magazine. “For those who expect near-shoring to increase, higher transportation cost was by far the most common reason cited (61%).</p>
<p>“In addition, the length of a global supply chain resulting in late deliveries also was cited as a significant reason to consider in-sourcing.”</p>
<p>Dittmann said that the survey — the first of its kind by the institute and trade organization should find out if firms were reducing their reliance on global off-shoring and do more near-shoring.</p>
<p>Nearly three-out-of-five respondents cited the low labor costs as the primary reason to continue off-shoring, Dittmann said, and when companies consider increasing their production capacity, 33% explored off-shoring.</p>
<p>This revelation, though, contradicts the growing concerns about the risk in off-shoring or outsourcing, Dittmann said in the article. Just slightly more than half of the executives (52%) said that they analyze and quantify risk in making decisions about outsourcing work. That means, Dittmann said, 48% do not analyze risk.<br />
Most companies consider unit freight costs when making decisions about outsouring, but only 48% weigh inventory costs.</p>
<p>“Inventory of course almost always increases significantly when production is outsourced,” Dittmann said. “And, for most firms, inventory represents a major cash flow challenge as well as a major expense.”</p>
<p><strong>Other survey highlights:</strong></p>
<ul>
<li>53% of executives think about potential disruptions in their supply chain when making a decision about outsourcing.</li>
<li>52% of respondents said they are “very or extremely concerned” about quality of outsourcing.</li>
<li>43% said their greatest fear is that the economics of the outsourcing decision will change.</li>
<li>59% use domestic talent to managing global relationships.</li>
<li>49% rely on hiring people who already have that expertise.</li>
</ul>
<p>Dittmann said the survey’s results answered some questions and raised others, “but hopefully provide much food for thought for firms managing a global supply chain.”</p>

<div id="oArticleText">Think illegally sharing passwords to online services is worth the risk? A landmark verdict handed down this week by a federal court that awarded<a href="http://tncommercialproperty.files.wordpress.com/2010/12/gavel.jpg"><img class="alignright size-medium wp-image-63" title="Gavel" src="http://tncommercialproperty.files.wordpress.com/2010/12/gavel.jpg?w=300&#038;h=199" alt="" width="300" height="199" /></a> more than $1.1 million in damages for illegally sharing passwords may convince you otherwise.&nbsp;</p>
<p>CoStar Group, Inc. (Nasdaq: <a href="http://quotes.nasdaq.com/quote.dll?mode=stock&amp;page=multi&amp;symbol=CSGP" target="_blank">CSGP</a>) announced a significant legal victory in breaking up a multi-state, multi-defendant password-sharing network that involved companies in Orange County, California, Houston, Texas, and Palm Beach Gardens, Florida. A federal court in Greenbelt, Maryland issued the verdict awarding CoStar more than $1.1 million in damages from two defendants engaged in flagrant and repeated violations of CoStar’s terms of use. The Court also ruled that CoStar was entitled to statutory copyright damages of $3,000 for each photograph infringed by the defendants.</p>
<p>The Court handed down separate verdicts of breach of CoStar’s terms of use and direct copyright infringement against Russ Gressett, an appraiser an dreal estate broker doing business under the name TGC Realty Counselors based in Houston, and Pathfinder Mortgage Corp., which does business in Orange County and elsewhere in California.</p>
<p>Gressett was ordered to pay CoStar $683,280 for sharing his CoStar user name and passwords with several Houston-area commercial real estate companies. He is also separately liable for $120,000 in copyright damages for copying of CoStar photographs. Pathfinder Mortgage Corp. was ordered to pay CoStar $483,120 for using passwords assigned to another company, while separately stating that CoStar was entitled to copyright damages of $438,120 for copying CoStar copyrighted photographs. Together, CoStar said it is entitled to collect more than $1.1 million in damages from the two defendants.</p>
<p>“This verdict is a victory for CoStar’s legitimate customers who are unfairly forced to compete with those who have illegal access to CoStar’s products,” said Jonathan Coleman, CoStar’s General Counsel.</p>
<p>Coleman said CoStar actively monitors its service for unauthorized access. In most cases, those found to be engaged in illegal password sharing are offered settlements and the opportunity to become legitimate subscribers. But for those who repeatedly violate the online terms of use, the costs can be millions of dollars in court-ordered restitution.</p>
<p>“Most companies that CoStar identifies as having shared passwords agree to settlements well before lawsuits are necessary,” he said. “The password sharing in this case was so blatant that CoStar had no choice but to bring it to trial.”</p>
<p>Two aspects of the verdict are especially noteworthy, according to Coleman. First, the Court held that the online terms of use on CoStar’s website were enforceable against those who use CoStar’s services, even if the user never read those terms. Second, the Court found that the copies made by the Defendants’ computers during the process of viewing CoStar’s copyrighted photographs was legally sufficient to put Gressett and Pathfinder Mortgage Corp. on the hook for copyright infringement.</p>
<p>CoStar separately received a default judgment against Mark Field after he failed to appear to be questioned in connection with the lawsuit. CoStar said it has received information that Field has left the United States.</p>
<p>Another defendant in the lawsuit, Lawson Valuation Group, Inc. of Palm Beach Gardens, Florida, filed for bankruptcy. CoStar had previously settled disputes with other individuals and companies involved in the password-sharing network for a fraction of the amounts assessed against Gressett and Pathfinder Mortgage Corp.</p>

<p>MVG Residential is expected to receive final approval this week to begin construction of a new 48 unit apartment site on Albert Gallatin Road in Gallatin.  According to the developer the project is funded and hoping to receive final approval from Gallatin&#8217;s Planning and Zoning Board on Monday.</p>
<p>MVG has worked diligently for over 3 years to enter the Tennessee Market with their Multi-Family product.  Gallatin and Sumner County appear to be the benefactor of the positive economic impact of this multi million dollar project.</p>

<p>Although energy-efficient retrofitting of commercial buildings has the potential to return twice as much in savings to owners and tenants as they require in investments, interest in pursuing retrofits has remained relatively low, dampened by the financial constraints on building owners from the economic recession, and lack of available financing options, according to a recent analysis of retrofit market opportunities by Boulder, CO-based Pike Research.</p>
<p>The new report states that 80% of all commercial buildings in the United States are now more than 10 years old. This large existing stock of inefficient buildings is also one of the leading sources of energy consumption and carbon emissions in the U.S.</p>
<p>According to this report, if all of the nearly 80 billion square feet of commercial space built as of 2010 were included in a 10-year retrofit program, based on today’s best practices, the savings in energy expenses would have the potential to reach more than $41.1 billion each year, based on an annual retrofit investment of $22.5 billion over the 10-year period.</p>
<p>&#8220;The building retrofit industry faces a number of key challenges,&#8221; said Pike Research managing director Clint Wheelock in a statement. &#8220;The current financial crisis has had a significant dampening effect on property owners’ investments in their properties. Financing for such projects is scarce, and the limited investment in building efficiency is not keeping pace with the growing national demand for energy.&#8221;</p>
